HealthLink services are provided by Synesis IT Ltd. for subscribers of Banglalink . HealthLink is a medical answering service through a call center where licensed doctors are available for 24 hours 7 days a week and 365 days a year basis to provide medical advices & information subject to following terms and conditions.
Banglalink subscribers, by dialing 789 from their BL mobile phone and establishing contact with the doctor of HealthLink confirms that he or she agrees to the terms and conditions of HealthLink mentioned hereinafter and also confirm that he or she is acting on his/her behalf or on behalf of any family member or dependent as a legal guardian (who is a minor or has been determined to be incompetent to give his/her medical consent):
1. Medical Consultation Services: Synesis IT through HealthLink will extend to all BL subscribers health related information and medical consultative services over mobile phone by physicians who are licensed to practice medicine in Bangladesh.
2. HealthLink Services:
Medical Advice / consultation from registered physicians 24 hours per day / 365 days a year:
This is the core service of HealthLink medical call center, i.e. to provide medical advice and consultancy from HealthLink (789) by physicians registered in Bangladesh; doctors at the HealthLink medical call center will provide guide lines to BL's mobile subscribers based on the complaints presented by the callers. The advising doctor will (i) screen emergency situations from non emergency situations of any callers; and (ii) advise patients for at home self-management if medical needs consist of minor complaints. For complicated medical needs, which may require physical examination and/or laboratory investigations then HealthLink call center doctors will ask patients or callers to visit a doctor or a hospital.
Doctor and medical facility information:
A database of phone numbers and contact addresses of available physicians (general practitioners and specialized consultants) and medical facilities (clinics and hospitals) are maintained and updated quarterly. Whenever a caller requests contact address and phone numbers of a general or specialized physician, the available information is given to the caller from the database. SYNESIS IT can not be held responsible for accuracy of information as contact numbers and/or addresses are obtained from third parties and information may change before delivery of information to callers.
Pharmacies help e.g. Drug Information:
Callers may have usual queries like when to take the medicine, before or after meal, side effects, contra-indications, etc. The doctors will respond with suggestions from their professional knowledge and may give suggestions from available drug data base as per usual practicing methods of general practitioners of Bangladesh.
Emergency support information; Vehicle and air ambulance dispatch services:
A database is maintained at HealthLink medical call center with available ambulance services within major metropolitan cities. When required by callers doctors provide to callers with phone number and contact address of the available ambulance service organizations from the database. It will be the responsibility of the callers to contact ambulance service organizations directly for any medical evacuation services that callers may require.
Interpretation of laboratory test reports and data:
Patients may have done pathological tests as part of their regular medical requirements or as asked by their own physician. After receiving the pathology test reports from laboratories, patients may have questions regarding interpretation of the reported data. Doctors of HealthLink will explain tests and reports of tests to callers if so asked by callers.
3. Mobile Phone Network: BL is the mobile phone GSM network provider of HealthLink. BL or its employees, officials and agents shall not be held responsible for any content or services under HealthLink and liable for any or all services containing allegations concerning SYNESIS IT's services and performance of its employees, officials, agents, subcontractors under HealthLink. As a phone company BL shall not be held responsible for such services and would not be eligible to be sued in the courts of law. There is a chance of interruption of conversation with doctors of HealthLink due to drop (disconnection) of line during any conversation over the hotline number of HealthLink due to any technical faults either of the mobile phone network or of the member's mobile set or as a result of mobility of the caller (e.g. commuting in any forms of vehicle) while talking through the hotline number. Both BL and SYNESIS IT shall not be held responsible for such losses of Voice Calls and associated costs may be applicable and payable by the callers.
4. Licensed Physicians: SYNESIS IT shall make physicians available, who are licensed to practice medicine in Bangladesh either from its own program or outsourced from other medical facilities. All professionals (physician, nurses, paramedics, pharmacists, etc.) working for HealthLink services are license holders or certified by the appropriate professional bodies or authorities to practice within their jurisdiction.
5. Addition or Removal of Services: SYNESIS IT and BL reserve the right to discontinue one or more products and services of HealthLink and also reserve the right to include additional services as may deem appropriate by the management of SYNESIS IT and BL.
6. Rights of Refusal to Provide Over-the-Phone Consultation from HealthLink by SYNESIS IT Appointed Doctors: All medical necessities or requirements can not be met by over-the-phone consultation with a doctor of HealthLink. Some medical situation may demand physical examination and/or laboratory investigations. In some cases, it might be advisable not to consult over-the-phone as a life-saving precaution. Doctors of HealthLink are specially trained to identify such critical or non-critical medical situations and shall advice callers to terminate consultation by doctor's own clinical judgment whenever such situation arises. The decision of HealthLink doctors will be final and callers agree to accept decision of the doctor and shall not ask for any refund for the call to HealthLink 789 number against such refusal by doctors.
7. Complains: Any complains by the member against any employees or services of HealthLink and against any third party medical service providers under HealthLink must be made to SYNESIS IT either in writing or calling a complaint phone number designated and dedicated for such complaints. SYNESIS IT will take reasonable and possible action against such complaints. SYNESIS IT will not accept any complaints without mobile phone number from where the call was made, name of complainant, date and time of incident, which will be kept confidential and independent from HealthLink employees by SYNESIS IT management. In case of complaints against third party medical service providers SYNESIS IT will take reasonable steps against such complaints, however, SYNESIS IT cannot guarantee remedy against such complaints and service quality of third party medical service providers. The management of SYNESIS IT will take reasonable measures to take in to account all complaints and initiate appropriate action at its own discretion as deemed necessary, the decision of the management of SYNESIS IT regarding resolution of complaints shall be final and binding upon BL and its subscribers.
8. Record of Conversation: SYNESIS IT reserves the right to record at random or constantly all conversation between the members and employees of HealthLink in order to ensure service quality, authenticity or evaluation purposes.
CALLERS CONSENT TO HEALTHLINK SERVICE POLICIES
1. Consent to Medical Advice over Mobile Phone: I (user of HealthLink services), voluntarily authorize rendering of medical advice including diagnostic interpretation and medical treatment advice, by authorized doctors or medical staffs of SYNESIS IT through HealthLink program, and the medical staff, or their designees, as may in their professional judgement be deemed necessary or beneficial to provide over-the-mobile phone medical consultation. I acknowledge that no guarantees have been made as to the effect of such over the phone medical advice on my condition or the condition of the person (for whom I am using HealthLink services) guarantees have been made as to the effect of such treatment advices on my condition or the condition of the person for whom I am duly authorized to act as guardian. I understand that I have the right to make decisions concerning my health care or the health care of the person for whom I am duly authorized to make such decisions, including the right to refuse any medical advice from HealthLink doctors.
2. Consent to Following Policies of SYNESIS IT Regarding Medical Advice from HealthLink:
That I am 18 years or older and my given name, sex, mobile phone number from which I am calling HealthLink is true and correct
. That I am the legal guardian if I am calling HealthLink for medical advice concerning a child;
2.3. That I have reasonable education to understand and write names of drugs being advised over-the-mobile phone to me in English or Bengali language by the HealthLink doctors, that I hold SYNESIS IT and its doctors harmless in case I fail to understand names of drugs being advised over phone and due to any complications arising out of failure of my part or of the part of HealthLink doctors to understand each other.
That I will not ask advice for any drug from HealthLink doctors, which requires written prescription.
That I will inform the Doctor of HealthLink if I am calling to help a unknown or unconscious person
That I will not use abusive language to Doctor(s) of HealthLink for any reason as I have options to complain to the management of SYNESIS IT for any undesired behaviors or acts of the staffs of SYNESIS IT. In case of abusive language usage by the caller HealthLink doctors deserve the right to discontinue over-the-mobile phone consultation.
That I will not practice any medical malpractice suit in any court of the country because the medical advices by SYNESIS IT Doctors over mobile phone are based on explanation of my or my relative's medical condition(s), where doctors can not examine me face-to-face, and I have the right to discontinue conversation with the HealthLink doctors at my sole discretion if I feel that my medical needs and doctors advices are not satisfactory for me or for my relative for whom I am using HealthLink services.
3. Third Party Services: I understand that except medical advices over mobile phone from HealthLink program, all services rendered by third parties (e.g. hospitals, clinics, laboratories, imaging centers, ambulance services, independent medical consultants, general practitioners are beyond the jurisdiction of SYNESIS IT and I will not hold SYNESIS IT and its directors, employees, agents, or any appointed person liable for any third party mal-practice and I will be responsible for payment of any services received from third parties, which may occur as a result of advices provided by employees of SYNESIS IT working for HealthLink.
4. Release of Information: I authorize the release of my medical records or the records of the person for whom I am duly authorized to do so, of such medical and/or psychiatric information as may be required by
Any health, sickness, and accident insurance carrier, workman's compensation or agency (social welfare, governmental) which is legally responsible, or which the HealthLink has good cause to believe is legally responsible for all or any part of the Medical Center's and/or professional fees.
Physicians or health care facilities rendering professional care to the patient.
The Peer Review Organization responsible for reviewing medical care.
5. Confidentiality of Information: HealthLink services complies with regulations governing the release of personal medical information; it assures confidentiality of information and permits HealthLink and SYNESIS IT to correspond with those agencies/persons having legitimate interest in the course of care rendered.
6. Procurement of Information: I authorize the release of any medical records of other physicians, hospitals or health care facilities that SYNESIS IT may need for my present medical care or the present medical care of the person for whom I am duly authorized to act.
7. Revoke: This consent may be revoked at any time, except to the extent that action has already been taken, by the patient/duly authorized agent and will expire automatically one year from the date of HealthLink service usage.
8. Limitations of Services: I have decided to use HealthLink services in order to assess my medical condition from time to time through tele-conversation with a doctor of SYNESIS IT. I understand that the consulting physician and I may be in separate locations and that an interactive audio connection will allow me and/or my provider and the consulting physician to understand each other during the consultation. Furthermore,
I understand that over-the-phone consultation may not be equal to a face-to-face visit since I will not be in the same room as the consulting physician, and that some parts of a physical exam may be conducted by individuals (medical or non-medical) present with me at the direction of the consulting physician. I also understand that individuals may be present at either location to operate the audio equipment and that these individuals must maintain confidentiality of health care information to which they become privy, and I consent to their presence.
I understand that there are possible risks of an incomplete or ineffective consultation because of the technology, and that if any of the risks occur, the consultation may not occur or may be stopped. I can ask that the consultation be stopped at any time as can my physician. These risks may include:
- The audio (mobile phone) connection may fail to work or may be interrupted or become disconnected during the consultation;
- The interactive connection may not provide a picture that is clear enough to meet the needs of the consultation;
- There is a small chance that someone could access the consultation through the interactive connection by electronic tampering.
9. Audio Recording: I understand that audio recording may be necessary to enable services from HealthLink program. The resulting audio recording will become part of my medical record, and I consent to the use of this audio tape for HealthLink program evaluation, education, research, or health care purposes only.
10. Compensation: I understand that in lieu of this HealthLink encounter, I may seek a face-to-face consultation with a health care provider independent of or associated with HealthLink program, and I understand that I am giving my informed consent to participate in HealthLink program. I further understand that I will not receive any royalties or other compensation for taking part in HealthLink or for the authorized use of any consultation audio.
11. Voluntary Consent: I certify that purposes and processes of medical advices through HealthLink program have been fully explained to me by a person (my family member or friend) who understands English and I have read and understood all terms, conditions and my consent to HealthLink services or have had it read to me. I understand the risks and benefits of the medical call center technology and consultation. I consent to such procedures and such medical consultation/advice over-the-phone for my current and future potential medical condition. I volunteer and consent to participate in this HealthLink program and release HealthLink, its personnel, SYNESIS IT, and any other persons participating in my care or this consultation from any and all liability which may or could arise from this HealthLink program, the use of interactive audio connections, or from the taking or authorized use of any audio recording obtained.
12. Declaration: I (user of HealthLink services) hereby state that all information given in this document is justified for the health benefit of my own or for the person for whom I am using HealthLink services and that the management of SYNESIS IT reserves the right to make any changes of contents, terms and conditions mentioned in this document. I have read and understood the terms and conditions and voluntarily consent to medical services rules of HealthLink and accept them as binding on me for myself and/or for my family member or dependent as a legal guardian (who is a minor or has been determined to be incompetent to give his/her medical consent). I, hereby agree to theses terms and conditions by dialing 789 to establish contact with a doctor of SYNESIS IT. By accepting all terms and conditions, I, hereby agree and undertake not to hold BL and SYNESIS IT liable for any health information and medical services of HealthLink.
NOTE: This document and its content is prepared by Synesis IT Ltd. and can not be amended, changed, modified or otherwise compromised without written consent of SYNESIS IT.
